Hon. Sarath Palitha Fernando
President's Counsel

 

Hon. Palitha Fernando was appointed as Attorney General of Sri Lanka on 17th July 2012. He is the 27th Attorney General of Sri Lanka.

Legal Career

The Hon Attorney General was admitted and enrolled as an Attorney-at-Law of the Supreme Court of Sri Lanka on 21st June 1979. He counts 32 years of service in the Attorney General's Department having joined the Department in 1980 as an Acting State Counsel. He was promoted as Senior State Counsel in 1989, Deputy Solicitor General in 1997, Additional Solicitor General in 2007 and appointed as Solicitor General in 2011. He was conferred silk in May 2007.

Mr. Fernando functioned as the head of the Criminal Division of the Department since 2007 until his appointment as Attorney General and during his long career, has appeared in several important and sensational cases including;

• The Hokandara Murder Case involving the massacre of 6 members of the same family. This is the first case in which DNA evidence was led in Sri Lanka,
• The case of defamation of President Chandrika Kumaratunga against Lasantha Wickramatunga, Editor of the Sunday Leader newspaper,
• The murder case of Wijedasa Liyanaarachchi, Attorney at law against Senior Police Officer Dharmadasa,
• The Udathalawinna Murder Trial at Bar and the Supreme Court Appeal,
• The Fundamental Rights application of Mr. Anura Bandaranaike, challenging the search of his residence,
• The Helping Hambantota Fundamental Rights application filed by President Mahinda Rajapakse, who was then the Prime Minister,
• The appeal of the Embilipitiya students disappearance case,
• The appeal in the rape case against actor Kamal Addaraarachchi,
• The Writ Application filed by former Minister S.B. Dissanayake,
• The Rule against Minister S.B. Dissanayake on a charge of contempt of the Supreme Court,
• The Parliament Bomb Case as junior to the then Attorney General Sunil de Silva,
• The case involving the bombing of the Avro Aircraft as junior counsel.

He has also conducted the prosecution at the following Presidential Commissions of Inquiry,

• Presidential Commission of Inquiry into the activities of Mossad in Sri Lanka in 1991.
• Presidential Commission to Inquire into the attack on the Bindunuwewa rehabilitation camp in October 2000
• The Presidential Commission to Inquire into the terrorist attack on the Air Force Base at Katunayake in July 2001

 

Whilst serving at the Attorney General's Department, Mr. Fernando assisted the Commission for the Investigation of allegations of Bribery and Corruption and has also served the Volunteer Force of the Sri Lanka Navy. Having been promoted as Rear Admiral, he served as Head of the Legal Division of the Sri Lanka Navy and Judge Advocate of the Sri Lanka Navy till 2004. He has served as prosecutor and Judge Advocate at several Courts Martial of all three armed forces.

Academic Background

Mr. Fernando is a Bachelor of Laws (LL.B) and Master of Laws (LL.M) (International law) of the University of Colombo, Sri Lanka. He also obtained his Master of Laws (LL.M) (International Commercial Law) from the University of Bristol, United Kingdom, having been awarded the prestigious Chevening Scholarship by the Government of the United Kingdom.

He was an outstanding student at the Sri Lanka Law College, passing the Preliminary and Final Examinations at the Sri Lanka Law College with First Class Honours. He was awarded the Prize for Commercial Law, the Hector Jayawardene Gold Medal for the First Place at the Address to the Jury Contest in English, the S.R.Wijeyatilake Challenge Shield for the First Place at the Address to the Jury Contest in Sinhala and the A.C. de Zoysa Challenge Shield for the first place at the Extempore speech competition in English. He also served as President of the Law Students' Union in 1978.

The Attorney General has served as a Lecturer at Sri Lanka Law College, a Visiting lecturer at the Open University of Sri Lanka, an Examiner in law at the Kotelawala Defence Academy, Visiting Lecturer at the Bandaranaike Diplomatic Training Institute, Visiting Lecturer at Army Staff Training College Sapugaskanda, Visiting Lecturer in law pertaining to Forensic Studies at the Medical Faculty University of Kelaniya Sri Lanka and Visiting Lecturer at the Department of Human Resource Advancement, University of Colombo. He has also served as a member of the Board of Examiners, University of Colombo, Sri Lanka at the external examinations in law, been a visiting lecturer Sri Lanka Judges Institute and was appointed a visiting lecturer for the LL.M programme, Faculty of Law, University of Colombo.

He has also presented papers and authored numerous articles on various topics relating to the law which have been published in journals of several academic and professional bodies, including the Universities of Colombo and Peradeniya, National Law Conference, Sri Lanka Law College, the Medico Legal Society and the Central Bank of Sri Lanka. He has also conducted lectures at several training programmes for law enforcement officials, government officers, medical officers and the general public, organized by the Dangerous Drugs Board of Sri Lanka, the National Child Protection Authority of Sri Lanka, the Sri Lanka Foundation Institute, the Medico Legal Society of Sri Lanka, National Center for Victims of crime in Sri Lanka, Institute of Human Rights in Sri Lanka, British Scholars Association of Sri Lanka, Asia Crime Prevention Foundation Sri Lanka, The Department of Labour Sri Lanka, College of Forensic Pathologists of Sri Lanka, the Law and Society Trust, The Bar Association of Sri Lanka, The Sri Lanka Medical Association, The Ceylon Chamber of Commerce, The Legal Aid Foundation of Sri Lanka and The Police Department of Sri Lanka. Mr. Fernando has participated as a resource person at several national and international conferences and has attended a large number of seminars and workshops both here and abroad.

Boards Served and Special Assignments

The Hon Attorney General has served as Member of the Board of Directors of the National Dangerous Drugs Board, a Member of the Board of Directors of the National Child Protection Authority, a Member of the Council of the University of Moratuwa, a Member of the Board for Forensic Studies of the Post Graduate Institute of Medicine, a Member of the Board of Governors of the Sri Lanka Youth Council, as Honorary Legal Advisor to the Sri Lanka Cricket Umpires Association and as a Member of the Syndicate of the Department of Human Resource Advancement, University of Colombo Sri Lanka. In addition, he served as the President of the Sri Lanka Medico Legal Society, Member of the Council of Legal Education of Sri Lanka, Chairman of the Criminal Justice Sector Coordinating Committee established by the Ministry of Justice in collaboration with the Swedish Government.

He was appointed by His Excellency the President as a Member of the Law Commission of Sri Lanka 2011. He led the Sri Lankan Delegation at the bilateral negotiations on a Treaty on Mutual Assistance on Criminal Matters with the United Arab Emirates Abu Dhabi October 2011 and Officiated as a Judge at the Henry Dunant Memorial International Moot Competition organized by the International Committee of the Red Cross, held in Kathmandu Nepal 2011.

Early Education

Mr.Fernando had his primary and secondary Education at Royal College, Colombo, where he excelled as a debater. He led both the College English and Sinhala debating teams, served as Student Chairman of the College English Literary Association and was the General Secretary of the Sinhala Literary Association. He there after studied law at the Sri Lanka Law College, University of Colombo and the University of Bristol, United Kingdom.
